# Does a cosmetics factory outside the US need a US Agent?

Yes. Under MoCRA, foreign facilities that manufacture or process cosmetics for distribution in the US must register with the FDA, unless an exemption applies, and must name a US Agent in the registration.

The US Agent is the FDA's contact in the United States for that facility.
